    The same is happening for me.  As a workaround, I found that if I cut and paste the layer in the site.xml and move it to the location I want, it moves it in the layer list.

    I was wondering if anyone had any luck figuring this out? 

    I'm using ArcServer 10 & whenever I add a new layer into the MXD then republish the map service it automatically adds this layer to the bottom of the list.

    Is there anyway to move it to the correct location in the table of contents without modiying the site.xml?

    We just installed GE 3.14 on our test environment and are noticing that a number of layers in TOC are out of order. A dozen or so. Seems random. It is just as described above - the site.xml is in wrong order, but nativeid is correct.

    This is a bit different from what you all describe but a similar type of issue. Any progress on this?
