Can a map service have scale dependent identification?

We had a service with a layer visible only to 1:8000 (metres). A user requested that layer be visible at all scales, so I change the 8000 to the full extent of our municipality. I can however, only identify at the previously visible scales and not at all the scales like I would expect.

We are still on Viewer for HTML 5. Is there a setting I need to tweak somewhere to make the identify work at all scales?
