Why is Filter Builder showing layer from a Basemap in dropdown?

Happy Friday,

STudio Web version: 5.35

We have a basemap that is setup in the Web map that has a tile layer that displays most base map layers.  Layered on the tile layer is a map image layer with only labels for points of interest (with data and query unchecked at the service level in settings for the map image layer) .  Below is a visual:

 

The basemap works well in our basemap picker.  

The problem is that in the Filter Builder, this layer appears at the top of the dropdown list.  It is confusing to users.  This layer does not appear in the Query Builder.

I have tried so many things to not have that layer displayed in the Filter Builder dropdown.  Does anyone know how to keep this from happening?

  By the way, the same thing happens if I set a custom basemap with a reference layer (as in the image seen below).
