Is the "incude in layer list" option gone in 4.2?

I have multiple map services that have scale dependent labeling or annotation layers that have numerous annotation types. Currently running Essentials 4.1.3 and Silverlight Viewer 2.2 and ArcGIS Server for Services 10.1. For example, I have a group layer called house labels, within the group layer are multiple scale dependent layers which while using the do not include in layer list option, the user only sees the house labels as a single layer. I am unable to see this option in 4.2. I am aware of the map service list and the layer list, but am unable to find a way to not include the layers within the group layer.

I have read the section on layer list configuration in the 4.2.0 in the administration guide and couldn't find a way to match the TOC functionality of 4.1.3.

I defer to this Silverlight Viewer for Geocortex thread who are experiencing similar headaches attempting to configure the layer list, layer themes and general table of content issues in Geocortex Essentials 4.1.x and SL2.2+
