4.2 Layer List - Top grouped layer is off but should be on

I have another strange one with 4.2 (and 4.2.1) and the layer list control

The top layer is a grouped layer in my mxd and is ticked on by default. The layer list shows it ticked on, but when I open the viewer it is ticked off. (silverlight)

From within manager I thought I would add a new Folder in the layer list above my 'Land Information' Grouped layer. The new folder is ticked on but set to not show in the layer list. Below image is the result. 

The 'Land Information' grouped layer is now ticked on in the viewer.

Just me or a possible bug?

  this is a bug becuase we have seen this too.

   

  Try editing the xml code as it seems the essentials manager does not communicate very well with the xml source code for the site.
